Our Law Firm Can Help Your Family Move Forward

The accidental death of a loved one is an incredibly difficult and overwhelming experience. You’re left to grieve and to work out how to move forward – and with no warning at all. If the death was the result of someone else’s negligence, then your family needs compensation and closure.

While taking legal action can never truly compensate for the loss of your loved one, an experienced wrongful death attorney can help provide the compensation you need to provide for the people left behind. Contact the Law Office of Mark B. Morse, LLC today for a confidential consultation in a safe and comfortable environment.

We Help Grieving Families File Wrongful Death Claims

A wrongful death claim is fundamentally a personal injury lawsuit filed on behalf of someone who has died. In Rhode Island, it falls to the executor or administrator of the deceased person’s estate to bring a wrongful death claim to court on behalf of the surviving family members. The family members themselves can also do so if the administrator does not after six months have passed from the date of death.

Some of the damages awarded in a wrongful death case are intended to compensate the deceased person’s estate for losses sustained prior to and due to the death. These include:

  • Medical expenses for the decedent’s final illness or injury.
  • Funeral and burial expenses.
  • Lost wages, including the wages the deceased person would have earned if he or she had lived.
  • Pain and suffering as well as emotional distress sustained by the deceased person.
  • Property damage sustained during the accident that caused the death.

Other damages can be awarded directly to the surviving family members, such as emotional distress they may have sustained due to the death as well as the loss of care, companionship, guidance, support and services that the deceased person provided.

Depending on the circumstances, there may also be criminal charges filed by the State of Rhode Island in connection with the death. That criminal case is separate and distinct from your wrongful death lawsuit, which is a civil case. Because civil courts have a lower burden of proof than criminal court, you may be able to recover damages even if the person responsible is acquitted of criminal charges.
